Seal of origin
The Seal of Origin is a special distinction from INAPI, that guarantees your consumers the unique character of your products.
In Chile there are more than 350.000 registered trademarks. Less than a 100 have Seal of Origin.
What is the Seal of Origin?
Is a special distinction that INAPI grants to products with unique characteristics, and that are produced in a certain geographical area.
What advantages does the Seal of Origin provide?
Using this distinction along with your trademark denotes its exclusivity, increases its visibility, and grants diferentiation from identical or similar products.
What are the
Seals of Origin?
INAPI has four categories of Seals of Origin
Geographical Indication
It's a distinction used for products which qualities derive from a determined geographical place, whether it's the region of production, extraction, growth, or manufacture. E.g. Bordeaux Wine
Appellation of Origin
In addition to the relation with the geographical place, other characteristic human factors must be proved, like special techniques or traditions in the manufacture. E.g. Iberian Ham
Collective Mark
It's a distinctive sign used to identify the origin, material or way of making of the goods or services produced by the members of an association. E.g. Girl Scout Cookies
Certification Mark
It's a distinctive sign that indicates that the product or service complies with a series of standards validated by a certification authority. E.g. California Certified Organic Farmers

Trademark registration process wih Seal of Origin

Broader Registrability Report
Besides the general registrability report, additional aforegoings have to be analyzed depending of the specific Seal of Origin.

Drafting of Documents
Drafting of all required documents according to the type of Seal of Origin to be requested.

Start of the Registration
Filing of the aforegoings of the tradermark to INAPI. Also, the initial rate of 1 UTM for each class must be paid.

Form Objections
INAPI could dictate form objections to one or more of the required documents, which should be answered and be solved.

Publishing in the Official Gazzette
Once the form examination has been approved, INAPI will order the publication of the mark in the Official Gazzete.

Oppositions and objections
30 working days term for third parties to oppose the registration of the brand, and finally INAPI will decide if it dictates substance objections.

End of Registration
If there is no opposition or substance objections, or if they are overcome in the legal process, INAPI will grant the brand. The rate of 2 UTMs must be paid for each class.

Trademark title and custody
We hand you the property title on your trademark, which attests your ownership for ten years, and provide free custody for it for two years.
